Abstract:
Whether the American criminal justice system should recognize a "cultural defense" for resident foreigners. A defense that may exonerate the foreigner of any wrongdoing if an otherwise illegal act would have been acceptable in the foreigner's homeland; includes examples of crimes committed in California by Japanese and Hmong individuals; application of the California Penal Code and the Model Penal Code to the two cases.
